Terms of Service
1. Who we are
Image2Video Studio is published by OSD365 Limited ("we", "us", "our"). When this document says "the app" or "the service", it means the Image2Video Studio Windows desktop software, the website at image2video.studio, and any related tools we make available.
2. Your account
To use the app you need an active subscription and an account. You agree to give us accurate information when you sign up, keep it up to date, and keep your sign-in credentials confidential. You are responsible for everything that happens under your account.
3. Subscription and payment
Image2Video Studio is sold on a yearly subscription basis at the price shown on the pricing page at the time you sign up. Subscriptions automatically renew on their anniversary date unless you cancel beforehand. We may change pricing for future renewal periods with at least 30 days' notice; the new price applies from your next renewal.
Payment is processed by Chargebee and Stripe. We don't store your full card number.
4. Free trial
If we offer you a free trial, you must provide a valid payment method to start it. At the end of the trial, your card will be charged the full subscription price unless you cancel before the trial ends. The details that apply during the trial — including the safety filter being locked on and the visible watermark on exported videos — are described on the pricing page.
5. Refunds
Our refund policy is described separately at refund policy and forms part of these terms.
6. Licence to use the app
While your subscription is active, we grant you a personal, non-exclusive, non-transferable licence to install and use Image2Video Studio on up to two computers you own or control, for any purpose permitted by these terms and the Code of Use.
You may not:
- Resell, sublicense, rent, lease, or otherwise transfer the app or your subscription to anyone else.
- Reverse engineer, decompile, or attempt to extract the source code, except to the extent that local law expressly permits this.
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices.
- Bypass, disable, or interfere with the licence-check, content credentials, content filter, or any other security or safety feature.
7. Your content
You keep ownership of the images you bring into the app and the videos the app generates from them. We don't claim any rights in your content.
Image2Video Studio embeds C2PA Content Credentials into every video it produces. These credentials are part of the video file and identify the app and the account that produced the video. By using the app, you consent to this embedding.
8. AI models and licences
Image2Video Studio uses third-party AI models curated and packaged by us. We've confirmed that the curated models permit commercial use. If you bring your own model into the app (an advanced option), the licence on that model is between you and its creator.
9. Acceptable use
You agree to follow the Code of Use. The Code lists a small set of prohibited uses — child sexual content, non-consensual intimate imagery, deepfakes of real identifiable people, fraud, and incitement to violence or hatred. Breach of the Code is grounds for immediate termination of your subscription without refund.
10. Privacy
Our handling of personal information is described in the privacy policy, which forms part of these terms.
11. Termination
You can cancel any time. Cancellation stops the next renewal; your subscription stays active until the end of the current term.
We can terminate your subscription if you materially breach these terms or the Code of Use. If we do, you forfeit any unused portion of the current term.
12. Disclaimer
The app is provided "as is". To the maximum extent permitted by law, we disclaim all warranties, express or implied — including warranties of merchantability, fitness for a particular purpose, and non-infringement. AI-generated output is unpredictable by nature; we do not warrant that the app will produce a particular result, that its output will be free of artefacts or errors, or that it will be uninterrupted.
13. Limitation of liability
To the maximum extent permitted by law, our total liability to you for any claim arising out of or related to the app is limited to the amount you paid us in the 12 months preceding the event that gave rise to the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages, lost profits, or loss of data.
14. Indemnity
You agree to indemnify and hold us harmless from any third-party claim arising out of your use of the app in breach of these terms or the Code of Use.
15. Changes to these terms
We may update these terms from time to time. If we make material changes, we'll give you reasonable notice — typically by email and on this page. Continuing to use the app after the changes take effect means you accept the new terms.
16. Governing law and disputes
These terms are governed by the laws of New Zealand. Any disputes will be resolved in the courts of New Zealand, except where local consumer-protection law gives you the right to bring proceedings in your own jurisdiction.
